SWCB Announces Removal of Authorizations for 3 Physicians:


The New York State Workers' Compensation Board on Tuesday announced the removal of three physicians from authorization lists allowing the treatment of injured workers or the performance of independent medical examinations.


SWCB Chairman Robert Beloten said he has revoked the treatment authorization of Dr. David Dinello, of Marcellus, N.Y., in response to disciplinary action taken on Nov. 22, 2010, by the State Board for Professional Medical Conduct. The Medical Conduct Board placed Dinello on probation for three years and banned him from the practice of emergency medicine.


Dinello was temporarily suspended by SWCB on April 5, 2010. Reports submitted by Dinello for services rendered prior to April 5 are to be considered valid.


Dr. Ramin Rak, of Commack, N.Y., voluntarily resigned his authorization to treat injured workers, effective on May 17, 2013. SWCB temporarily suspended Rak's authorization on March 5, 2013. On March 1, the Board for Professional Conduct found Rak guilty of misconduct and placed him on probation for 36 months.


Reports submitted by Rak for services rendered prior to March 5 are to be considered valid, Beloten said.


Dr. Zahid Hussain, of Uniondale, N.Y., resigned his authorization to treat injured workers, effective May 18, 2013. Hussain's authorization to perform IMEs was revoked by SWCB on April 13, 2011.


The Board for Professional Medical Conduct banned Hussain from practicing medicine in New York state on July 6, 2011, pending conclusion of an investigation being conducted by the New Jersey State Board of Medical Examiners.


Beloten said IMEs conducted by Hussain prior to April 13, 2011, are to be considered valid.
